Topical Commentaries on the 1917 Code

Overview

This page is under

continual development

For further insight into the meaning of Pio-Benedictine law canonists, having consulted, if possible, one or more pan-textual commentaries on the law, turned to one or more of the topical commentaries on the 1917 Code. For present purposes 'topical commentaries' are those treating entire books of the Code, parts of books, and sections of parts.

Users of this page should be generally familiar with the materials presented on the Masterpage on the Pio-Benedictine Code of 1917, here, and specifically familiar with its discussion of Commentaries, here.

General Background

 • Pan-textual Commentaries on the 1917 Code, here.

The authors of or contributors to the works listed below would be considered "approved authors" and/or "learned persons" for purposes of canonical interpretation. Those works that seemed to have been 'Highly regarded' or 'Well regarded' during the enforcement period of the 1917 Code are so noted. Most of these works were written by single authors and appeared in monographs.

Great care is being applied toward accuracy in the Codex Vivens but no warranty of completeness or accuracy is made; moreover, characterizations and opinions are mine.

Comment: The 1917 Code experienced scores of authentic interpretations all of which can be found in the Acta Apostolicae Sedis, but two private compendia of interpretations are far more practical. The final, definitive editions of these two works, essentially coextensive with each other, are:

Cosmas Sartori (Italian Franciscan, 1890-1957), Enchiridion Canonicum seu Sanctae Sedis Responsiones post Editum Codicem I. C. Datae, 10th ed., rev. by B. Belluco, (Antonianum, 1961) 455 pp. Review: J. Schmidt, The Jurist 22 (1962) 486-487; and,

There are earlier editions of these two works and there are similar, but not as complete, compilations made by others (e.g., Woywod, Bruno) but access to the final editions of Sartori or Regatillo would obviate the need to consult other compilations.

The 6,464 ecclesiastical documents that Gasparri actually used for the 1917 Code (God knoweth how many other documents Gasparri and his small staff had examined) fill more than 7,700 pages in P. Gasparri & J. Serédi, eds., Codicis Iuris Canonici Fontes, in 9 vols., (Typis Polyglottis Vaticanis, 1923-1949) [herein CIC Fontes]. As sources for the 1917 Code, these collected documents are to be consulted along with thousands of individual texts taken from the Corpus Iuris Canonici (CIC Fontes IX: 13-118) and from scores of canons and decrees of the Council of Trent (CIC Fontes IX: 120-135).
