Resources in Nineteenth & Early Twentieth Century Canon Law

          The following sources and studies in canon law are useful in understanding the state of canonistics in the decades immediately preceding the appearance of the 1917 Code.

The Big Four

 

Actually, each of these works was originally published prior to the 19th century, but they were so widely in use through the end of the "Ius Novissimum" that they need to be listed here for accuracy's sake.

  • Lucius Ferraris, Prompta Bibilioteca canonica, juridica, moralis, theologica, necnon ascetica, polemica, rubricistica, historica, 7 vols., plus 2 supplemental volumes (many editions from 1746 thru 1899). Really a multi-volume encyclopedia, but contains numerous very important canonical entries and discussions. Franciscan. Widely cited, a key work.

  • E. Pihring, Ius Canonicum, 4 or 5 volumes, (1674).

  • Johann Georg Reiffenstuel, Jus Canonicum Universum, usually bound as 6 vols., several editions from 1700 through mid-19th century. Franciscan. Immense authority.

  • Francis Xavier Schmalzgrueber, Jus Ecclesiasticum Universum, 5 vols., usually bound as 12, editions beginning in 1717 through mid-19th century. Jesuit. Immense authority.

General Studies

  • = Aichner, Compendium Juris Ecclesiastici, (1895).

  • P. De Angelis, Praelectiones Iuris Canonici (1877).

  • = Audisio, Droit Publique de l'Eglise, 3 vols., (1865).

  • F. Cavignis, Institutiones Juris Publici Ecclesiastici, (1882).

  • J. Devoti, Jus Canonicum Universum, (1837). Apparently only 1 volume appeared.

  • J. Devoti, Juris Canonici Universi Publici et Privati Libri Quinque, 3 vols., (1803).

  • E. Grandclaude, Ius Canonicum (1882).

  • F. Heiner, Katholisches Kirchenrecht, 2 vols., (1893-1894).

  • C. Herbermann, ed., The Catholic Encyclopedia, 16 vols. Appeared in the years just before promulgation of the 1917 Code, its numerous canonical entries are a good snapshot of canonistics at the end of the decretal era. Available at New Advent.

  • L. Huguenin, Expositio Methodica Juris Canonici (1867), 2 vols.

  • I. Laurentius, Institutiones Iuris Ecclesiastici (1908), 712 pp.

  • F. Laurin, Introductio in Corpus Iuris Canonici (1889).

  • Libertore, =, Droit Publique de l'Eglise, (1892).

  • F. Maasen, Geschichte der Quellen u. der Literatur des Canonischen Rechts (1870). Only one volume seems to have appeared.

  • S. Smith, Elements of Ecclesiastical Law, 3 vols., numerous editions. Excellent work.

  • E. Taunton, The Law of the Church: a Cyclopaedia of Canon Law of English-speaking Countries, (1906), 652 pp. A great achievement.

  • A. Tilloy, Traité Théorique et Practique de Droit Canonique, 2 vols., (1895).

  • S. Vechiotti, Institutiones Canonicae, 3 vols., often bound as one, doubled-columns (1875).

  • = Von Scherer, Handbuch d. Kirchenrechts, 2 vols. (1886).

  • F. Wernz, Ius Decretalium, usually appears as 7 vols (1898-1906). Highly regarded. If a "fifth" were ever added to the "Big Four" above, it would be Wernz, the only work actually penned during the 19th century.

  • J. Zallinger, Institutiones Iuris Ecclesastici, 5 vols., (1832).

  • Z. Zitelli, Apparatus seu Compendium Iuris Ecclesiastici, Par I De Personis, Pars II De Rebus, (1907).

  • M. Lega, Coram Lega habitae S. R. Rotae Decisiones sive Sententiae ...1909-1914, (1926), 604 pp. A collection of sentences on a variety of issues, as penned by one of the Rota's finest minds.

  • S. Smith, The New Procedures in Criminal and Disciplinary Causes of Ecclesiastics in the United States (1887). Prompted by the promulgation of S. C. de Prop. Fide, instruction Cum magnopere (1884).

 

Special Studies

  • H. Pezzani, Codex Sanctae Catholicae Romanae Ecclesiae, 3 vols. (1893). One of several proto-codifications of canon law that served as models for the eventual project undertaken by Gasparri. See also similar efforts by de Luise (1873), Pillet (1890), Russo (1904), and Collomiati (1898-1907). F. Deshayes,  Memento Juris Ecclesiastici (1894/1897) while grouped with the above, is more of a manual on canon law, though much of it would lend itself to use in a code.
